Terms of Service

1. Agreement

By using ProRank's services ("Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our Services. These Terms apply to all clients, visitors, and users of prorank.in.

2. Services

ProRank provides AI-powered automation services including, but not limited to:

• Google review monitoring and AI-generated review responses
• WhatsApp AI customer engagement agents
• Google Maps / local SEO optimization
• Social media content generation and automated posting to Instagram and Facebook
• Analytics and reporting dashboards

Service details and deliverables are defined in your individual service agreement.

3. Payment terms

• Setup fee: Due before work begins. Non-refundable once setup is completed.
• Monthly retainer: Billed on the 1st of each month. Due within 7 days of invoice.
• Late payments: Services may be paused for payments overdue by more than 15 days.

4. Your responsibilities

• Provide access to Google Business Profile, WhatsApp Business, and other required accounts
• Ensure information provided (product catalogues, pricing, etc.) is accurate
• Respond to escalated enquiries flagged by our AI within 24 hours
• Comply with Google's and WhatsApp's terms of service

5. AI-generated content

Our AI generates review responses, WhatsApp messages, and marketing content on your behalf. While we fine-tune the AI to match your brand voice, you are responsible for reviewing and approving automated communications. We are not liable for any misrepresentations made by AI-generated content.

6. Cancellation

• Either party may cancel with 15 days written notice
• Upon cancellation, we export all your data and delete it within 30 days
• No refunds for partial months of service
• Setup fees are non-refundable once system build is completed

7. Satisfaction guarantee

If you do not see measurable improvement in reviews, response times, or customer enquiries within the first 30 days, we will refund your first month's retainer in full. This does not apply to setup fees.

8. Limitation of liability

ProRank's total liability to you for any claims arising from these Terms shall not exceed the total amount paid by you in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunities.

9. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

10. Changes to these terms

We may update these Terms from time to time. We will notify you of significant changes via email. Continued use of our Services after changes constitutes acceptance.
